Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Frequency application and website located at readmyfrequency.com (collectively, the "Service"), operated by Nuralyn LLC ("Nuralyn," "we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Eligibility

You must be at least 13 years of age to use the Service. By using Frequency, you represent and warrant that you meet this age requirement. If you are between the ages of 13 and 18 (or the age of legal majority in your jurisdiction), you may only use the Service with the consent of a parent or legal guardian who agrees to be bound by these Terms.

2. Description of the Service

Frequency is an AI-powered emotional spectrum analyzer. Users submit text, and the Service analyzes it across seven rhetorical and emotional dimensions — Power, Fear, Desire, Deception, Urgency, Trust, and Contempt — returning scored results, highlighted phrases, and a summary.

Analysis results are generated by artificial intelligence and are provided for informational and entertainment purposes only. They do not constitute professional psychological, legal, medical, or counseling advice. You should not rely on the Service as a substitute for professional judgment.

3. Accounts

Certain features of the Service require you to create an account. When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain the security and confidentiality of your login credentials
• Notify us promptly of any unauthorized access to or use of your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate your account if any information provided is inaccurate, misleading, or incomplete, or if you violate these Terms.

4. Free Tier & Subscriptions

a. Free Tier

Frequency offers a limited free tier that includes up to 3 text analyses. No account is required to use the free tier. Free tier availability and limits may change at any time without prior notice.

b. Paid Subscription

Unlimited access to the Service is available through a paid subscription at the price displayed at the time of purchase. Subscriptions are billed on a recurring monthly basis through Stripe.

c. Billing & Renewal

By subscribing, you authorize us to charge your selected payment method on a recurring basis at the then-current subscription rate. Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date.

d. Cancellation

You may cancel your subscription at any time by contacting us at support@nuralyn.com. Cancellation takes effect at the end of the current billing period. You will retain access to the Service for the remainder of the period you have already paid for. No partial refunds are provided for unused portions of a billing cycle.

e. In-App Purchases (Mobile)

If you subscribe through the Apple App Store or Google Play Store, your purchase is also subject to the terms and conditions of the respective platform. Payment will be charged to your App Store or Google Play account. To manage or cancel a subscription purchased through a mobile platform, you must do so through that platform's subscription settings.

f. Price Changes

We reserve the right to change subscription pricing. If we change the price, we will provide at least 30 days' notice before the new price takes effect. Your continued use of the Service after a price change constitutes acceptance of the new price.

5. Acceptable Use

You agree not to use the Service to:

• Submit text that is unlawful, threatening, harassing, defamatory, obscene, or otherwise objectionable
• Violate any applicable local, state, national, or international law or regulation
• Infringe upon the intellectual property or privacy rights of any third party
• Attempt to gain unauthorized access to the Service, other user accounts, or related systems
• Interfere with or disrupt the Service or servers/networks connected to the Service
• Use automated scripts, bots, or scrapers to access the Service without our prior written consent
• Reverse engineer, decompile, or disassemble any aspect of the Service
• Use the Service to build a competing product or service

We reserve the right to suspend or terminate access to the Service, without notice, for any user who violates these Terms.

6. User Content

"User Content" refers to any text you submit to the Service for analysis. You retain all ownership rights to your User Content. By submitting text, you grant us a limited, non-exclusive, royalty-free license to process the text solely for the purpose of providing the analysis results to you.

We do not store, log, or retain User Content after the analysis is complete. We do not use your submitted text for training AI models, advertising, or any purpose other than delivering results to you in real time.

You are solely responsible for the text you submit and represent that you have the right to submit it for analysis.

7. Intellectual Property

The Service, including its design, code, visual elements, branding, and all related content, is owned by Nuralyn LLC and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right, title, or interest in the Service except for the limited right to use it in accordance with these Terms.

"Frequency," the Frequency logo, and related marks are trademarks of Nuralyn LLC. You may not use our trademarks without our prior written permission.

8. AI-Generated Results

The analysis results provided by Frequency are generated by artificial intelligence and may not be accurate, complete, or reliable. AI-generated output can contain errors, biases, or misinterpretations.

You acknowledge and agree that:

• Results are not a substitute for professional analysis or judgment
• Results should not be used as the sole basis for decisions with legal, financial, medical, or personal consequences
• We make no warranty regarding the accuracy or reliability of any analysis
• You use the results at your own discretion and risk

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NURALYN LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY ANALYSIS RESULTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NURALYN LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

• Your use of or inability to use the Service
• Any content or results obtained from the Service
• Unauthorized access to or alteration of your data
• Any third-party conduct on the Service

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50.00), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

11. Indemnification

You agree to indemnify, defend, and hold harmless Nuralyn LLC and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of a third party
• Any User Content you submit to the Service

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately.

You may terminate your account at any time by contacting us at support@nuralyn.com. Sections of these Terms that by their nature should survive termination — including but not limited to Sections 7, 9, 10, 11, and 14 — shall survive.

13. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, either party may pursue resolution in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

15. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the "Effective Date" at the top of this page. If we make material changes, we will notify you by posting a prominent notice within the app or by sending you an email. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.

16. Apple & Google App Store Terms

If you access the Service through a mobile application downloaded from the Apple App Store or Google Play Store, the following additional terms apply:

• These Terms are between you and Nuralyn LLC only, not with Apple Inc. or Google LLC.
• Nuralyn LLC, not Apple or Google, is solely responsible for the Service and its content.
• Apple and Google have no obligation to provide maintenance or support for the Service.
• In the event the Service fails to conform to any applicable warranty, you may notify Apple or Google for a refund of the purchase price (if any). Beyond that, Apple and Google have no other warranty obligation with respect to the Service.
• Apple and Google are not responsible for addressing any claims by you or a third party relating to the Service.
• In the event of a third-party intellectual property claim, Nuralyn LLC, not Apple or Google, shall be solely responsible for the investigation, defense, settlement, and discharge of such claim.
• Apple and Google and their subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and you are not on any U.S. Government prohibited or restricted party list.

17. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Nuralyn LLC regarding your use of the Service and supersede all prior agreements and understandings, whether written or oral.
